Best Buy @15TM Challenge with Youth Venture
Online and SMS Voting Rules
Best Buy Children’s Foundation and Youth Venture have established these terms and conditions (the “Voting Rules”) to govern the voting aspect of the Best Buy @15TM Challenge with Youth Venture, a challenge for selected Youth Venture teams where fifteen (15) winning teams will receive a grant from the Best Buy Children’s Foundation (the “Challenge”). These Voting Rules are available at www.GenV.net (the “Youth Venture Website”).
1. THE @15 CHALLENGE
Youth Venture has selected thirty (30) previously established Youth Venture teams to compete in the Challenge (the “Finalist Teams”). By voting at this stage of the Challenge (the “Voting Period”), youth will help decide which fifteen (15) Finalist Teams (the “Winning Teams”) receive $10,000 grants from the Best Buy Children’s Foundation. Grants will be awarded pursuant to the Best Buy @15TM Challenge with Youth Venture Terms and Conditions, available on the Youth Venture Website (the “Challenge Terms and Conditions”)
2. ELIGIBILITY
You must be a legal resident of the United States to be eligible to vote during the Voting Period. Employees of Ashoka, Youth Venture, the Best Buy Children’s Foundation, and their respective affiliates, subsidiaries, parent corporations, advertising and promotional agencies, and all others associated with the development and execution of the Challenge and the immediate family members and members of the households of any of the foregoing are ineligible to vote. “Household members” shall mean people who share the same residence at least three (3) months a year. Void in Puerto Rico, U.S. territories and possessions, U.S. military installations in foreign countries, and where prohibited or restricted by law. All U.S. federal, state, and local laws and regulations apply.
3. VOTING PERIOD
Voting will take place from December 1, 2008 until January 9, 2009 (the “Final Day”). All votes must be received by 11:59 PM EST on the Final Day in order to be counted.
4. VOTING GENERALLY
You may vote for up to three (3) teams per day each day during the Voting Period. You may vote for two teams per day online and one team per day via SMS. Limit three votes per person, per day.
5. VOTING ONLINE
To ensure that your votes are counted, you must comply with the following requirements:
a. You may only vote online one (1) time per twenty-four (24) hours, and each time you vote online, you must cast a vote for two (2) Finalist Teams. You must vote for two (2) different Finalist Teams.
b. You may not cast votes from more than one e-mail address per twenty-four (24) hour period, however, voting online does not prohibit you from voting via SMS within the same twenty-four (24) hour period, as set forth in Section 6. (When voting via SMS, you may vote for either of the two Finalist Teams you voted for online that day or you can vote for a different team.)
c. All votes must be cast no later than 11:59 pm EST on the Final Day.
6. VOTING VIA SMS
To ensure that your vote is counted, you must comply with the following requirements:
a. You may only vote via SMS one (1) time per twenty-four (24) hours, and each time you vote via SMS, you may only cast one (1) vote for one (1) Finalist Team.
b. You may not cast votes from more than one cell phone number per twenty-four (24) hour period, however voting via SMS does not prohibit you from voting online within the same twenty-four (24) hour period, as set forth in Section 5. (When voting online, you may vote for the Finalist Team you voted for via SMS that day or you can vote for a different team.)
c. All votes must be cast no later than 11:59 pm EST on the Final Day.
When you cast a vote via SMS, standard SMS-messaging rates charged by your wireless provider apply.
7. VALIDATING AND COUNTING THE VOTES
Youth Venture will be solely responsible for confirming votes and tallying the number of votes confirmed for each Finalist Team. On or about January 16, 2009, Youth Venture and the Best Buy Children’s Foundation shall announce on the Youth Venture Website and the Best Buy Children’s Foundation’s designated website the fifteen (15) Finalist Teams that received the most votes. No delay in the announcement by the Best Buy Children’s Foundation or Youth Venture shall be construed to provide any person with additional time to cast or confirm a vote.
Youth Venture reserves the right to disqualify any vote if Youth Venture determines, in its sole discretion, that a vote was cast in violation of these Voting Rules, including a determination that any person cast more than the permissible number of votes in any twenty-four hour period. Youth Venture may consult at its discretion with the Best Buy Children’s Foundation with respect to all aspects of counting and validating votes. Youth Ventures’ decisions with respect to the counting and validating of votes shall be final and binding.
In the event of a dispute, a vote will be deemed submitted by the authorized account holder of the e-mail account or wireless telephone number from which the vote was cast. The “authorized account holder” is defined as the natural person who is assigned to an e-mail address or wireless number by an internet access provider, internet service provider, wireless communications provider, or other online or similar organization (e.g. business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address or wireless numbers for the wireless network associated with the applicable wireless number. Votes originating at any website other than the Youth Venture Website, including, but not limited to, subscription notification and/or entering service sites, will be declared invalid and not accepted. Sponsor reserves the right to reject votes that Sponsor determines were mechanically generated, in Sponsor’s sole and absolute discretion. False, fraudulent or deceptive votes or acts shall render vote and voters ineligible.
8. GRANT AWARDS
The fifteen (15) Winning Teams in the Voting Period will receive grants of $10,000 each from the Best Buy Children’ Foundation to be distributed by Youth Venture, subject to the Challenge Terms and Conditions.
Youth Venture and the Best Buy Children’s Foundation will only make grants totaling $150,000 in connection with the Voting Period. In the event of a tie between any two Finalist Teams, the grants shall be awarded to the Finalist Teams that are the first to receive the highest number of votes, based on the date and time of such votes.
9. RELEASE; CANCELLATION OR MODIFICATION
Youth Venture, Best Buy Children’s Foundation and each of their respective affiliates, subsidiaries, parent corporations, retailers and advertising and promotional agencies, and the officers, directors, shareholders, employees, and agents of each of the foregoing and all others associated with the development and execution of this Voting Period (collectively, "Releasees") will not responsible for lost, misdirected, illegible, incomplete, or late votes. Releasees are also not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender or by any of the equipment or programming associated with or utilized during the Voting Period that may limit the ability to vote or participate, or any human error that may occur in the processing of the votes. If for any reason (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Youth Venture that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the voting process), the Voting Period is not capable of being conducted as described in these Voting Rules, Youth Venture shall have the right, at its sole discretion, to cancel, terminate, or suspend the Voting Period. If such cancellation, termination, modification, or suspension occurs, notification will be posted on the Youth Venture Website. In such event, Youth Venture will select the fifteen (15) Winning Teams based on the number of valid votes received as of the date of cancellation, termination, or suspension of the Voting Period. While Youth Ventures reserves the right to reject votes cast in violation of these rules, it is under no obligation to detect or reject such votes.
10. USE OF INFORMATION
Youth Venture and the Best Buy Children’s Foundation are committed to maintaining and preserving your privacy. Accordingly, please note that any information you provide to Youth Venture and the Best Buy Children’s Foundation during the Voting Period will be governed by the terms of the Privacy Policy on the Youth Venture Website.
11. ACKNOWLEDGMENT
By voting in the Voting Period, voters affirm that they have read and agree to be bound by these Voting Rules.

Eligibility. How to Enter.
To enter the Best Buy @15TM Challenge with Youth Venture Voter’s Sweepstakes (the “Promotion”), simply visit www.GenV.net/BestBuy (the “Site”) between 12/01/2008 and 12/26/2008 (“Promotion Period”) and complete the online form when you vote for Youth Venture finalist teams under the Best Buy @15TM Challenge on the Site. You will be asked to provide your name, daytime telephone number, and email address when you enter. You can enter online up to one (1) time per twenty-four (24) hour period during the Promotion Period. All entries must be received by 11:59 p.m. as of 12/26/2008. Limit one (1) entry per person, per day during the Promotion Period.

Each winner may be requested to provide Sponsor with proof that the winner is the authorized account holder of the e-mail address associated with the winning entry. Entry must be made only at the Site. Entries originating at any other website or e-mail address, including, but not limited to, commercial Promotion subscription notification and/or entering service sites, will be declared invalid and not accepted. Mechanically reproduced or automated entries will not be accepted. False, fraudulent or deceptive entries or acts shall render entrants ineligible. By entering the Promotion, entrants affirm that they have read and agree to be bound by these Official Rules.
Prizes. A total of four (4) prizes will be awarded. Four (4) winners will receive a prize package consisting of:
• the opportunity to select a school or nonprofit entity meeting certain requirements to receive a $500 charitable donation to be delivered directly to such school or nonprofit entity (Approximate Retail Value (APR): $500); and
• one (1) iPod Shuffle (APR: $49).
APR of each Prize: $549. APR of all Prizes: $2,196.
Prize Drawing. Each calendar week during the Promotion Period, from 12/01/2008 to 12/26/2008, Sponsor will randomly select one (1) winner from the entries received at the end of each week. Non-winning entries from each weekly period will be rolled over into the next week’s drawing. A total of four (4) winners will be selected. Winners will be notified by phone or e-mail within seven (7) business days of each drawing date and will be required to execute and return a notarized Affidavit of Eligibility/Release of Liability and, where legal, a Publicity Release form within ten (10) days. Such forms must also be executed by signed by winner and/or winner’s parent or guardian, where applicable. In addition, each winner will be required to execute and return a form containing certain information regarding such winner’s choice of school or nonprofit entity eligible to receive the $500 donation. Each winner must specify two choices: the top choice and an alternate choice in the event Sponsor determines that the winner’s top choice does not meet Sponsor’s criteria. Winners must comply with certain criteria to be provided by Sponsor in selecting such school or nonprofit entity. Failure of any winner to return all required forms within this time period, noncompliance with Sponsor’s requirements in selecting a school or nonprofit entity to receive the charitable donation, noncompliance with these Official Rules, or return of Promotion notification as undeliverable will result in winner's disqualification and forfeiture of the prize and an alternate winner will be selected from the remaining eligible entries. Within thirty (30) days of Sponsor’s receipt of the required and valid documentation back from each confirmed winner, a $500 charitable donation will be delivered directly to each winner’s selected and eligible school or nonprofit entity and an iPod Shuffle will be sent to each winner’s provided address. Sponsor reserves the right to reject a winner’s selections of school or nonprofit entity for any reason and require such winner to select an alternative school or nonprofit entity. Winners agree that Sponsor has neither made nor is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the iPod shuffle, except that the iPod shuffle will come with the manufacturer’s standard limited warranty.
Odds of Winning. Odds of winning depend on the number of eligible entries received.
General: Information submitted by entrants will be used by Sponsor and its affiliates to contact them by mail and/or email with information about Sponsor and its educational and outreach programs. All such information will be used in accordance with the Privacy Policy on the Youth Venture website located at www.genv.net. Any entry information collected from the Promotion shall be used only in a manner consistent with the consent given by entrants, these Official Rules, and Sponsor's online privacy policy located on the Site. In the event any prize, or portion thereof, is unavailable for any reason, Sponsor reserves the right to substitute a comparable prize of equal or greater value. Winners agree that Sponsor has neither made nor is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize or component thereof, including, but not limited to, its quality, mechanical condition or fitness. Taxes on prizes, if any, are the sole responsibility of winners and their selected school or nonprofit entities receiving charitable funds pursuant to this Promotion. By accepting the prize, each winner (i) releases Releasees from and against any and all liability in any way arising from or related to this Promotion and/or the acceptance, use or misuse of any prize, including, without limitation, liability for personal injury, death, damages or loss, and (ii) consents to the use of winner’s name, voice, image, and likeness for promotional, advertising, publicity or trade purposes in any media worldwide in perpetuity by Sponsor without further compensation, unless otherwise prohibited by law. Any attempt by an entrant to supply false information, obtain entries by fraudulent means, deliberately damage any website (including the Site) or undermine the legitimate operation of the Promotion is a violation of criminal and/or civil laws and should such an attempt be made, Sponsor reserves the right to seek damages and other remedies to the fullest extent permitted by law. By entering the Promotion, entrants hereby submit to the jurisdiction and venue of the federal and state courts of the United States and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum.
